Terms of Service
These Terms of Use V1.1 are effective on July 29, 2026.
1. Agreement to these Terms
By creating an account, joining a session, or otherwise using Nanovote (the "Service"), you agree to these Terms of Service (the "Terms") and to our Privacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you confirm that you are authorized to bind that organization to these Terms.
2. Who we are
The Service is operated by Stanislav Yefimenko, PE (ФОП) in Ukraine ("Nanovote", "we", "us", "our"). You can contact us at [email protected].
3. What Nanovote is
Nanovote is a tool for making group decisions. You can create sessions, invite people, and collect votes, polls, rankings, or numeric inputs. The contents of options and votes are encrypted on participants' devices, so that we cannot read them, and results are calculated on participants' devices rather than by us.
Nanovote is a convenience tool for private group decision-making. It is not an official, certified, or legally binding election, ballot, referendum, or voting system, and you must not rely on it as one. You are responsible for deciding whether the Service is appropriate for your purpose.
4. Eligibility
You must be at least 18 years old to use the Service, whether you register an account or take part as a guest. By using the Service, you confirm that you are at least 18, that any information you provide is accurate, and that you are not barred from using the Service under any applicable law.
5. Your account and recovery phrase
- You can use Nanovote as a guest or by registering an account. Create an account only for yourself, unless you are authorized to create one on behalf of an organization. Provide accurate information, keep it up to date, and keep your credentials confidential.
- Because your data is protected with keys derived from your password, we cannot reset your password or recover your account for you. When you register, you receive a 24-word recovery phrase — it is the only way to regain access if you forget your password. Keep it private and safe. If you lose both your password and your recovery phrase, your account and its data cannot be recovered. This is a deliberate part of the design.
- You are responsible for activity that happens under your account. Contact us promptly at
[email protected]if you believe your account has been used without your authorization. - You may not sell, rent, share, or transfer your account, and you may not impersonate any person or organization.
6. Your content and your invitations
- "Your content" means the sessions, options, votes, messages, images, and other material you submit. You keep whatever rights you already have in your content.
- You grant us a limited, worldwide, royalty-free license to host, store, transmit, and display your content solely to operate and provide the Service to you and the participants you choose. This license ends when the content is deleted, except for content other participants still retain and for routine backups that age out over time.
- Because your content is encrypted and we cannot read it, we do not and cannot monitor, moderate, screen, or verify it. You are solely responsible for your content, for the sessions you run, for any decision you make using the Service, and for the people you invite.
- Invite links are access keys. Anyone who has a session's invite link can join and view that session. Share invite links only with the people you intend to include, and treat them like passwords.
7. Acceptable use
You agree not to use the Service to:
- break any law or regulation, or enable anyone else to do so;
- infringe anyone's intellectual-property, privacy, publicity, or other rights;
- upload or share content that is unlawful, violent, hateful, discriminatory, harassing, abusive, defamatory, sexually explicit or pornographic, or that exploits or endangers minors;
- stalk, bully, threaten, or intimidate any person;
- post or share other people's private or confidential information — such as payment-card numbers, government-ID numbers, or non-public phone numbers or email addresses — without their consent;
- solicit, collect, or use other people's login credentials;
- send spam or unsolicited messages, or invite people who have no reason to expect contact from you;
- run sham, fraudulent, or deceptive votes, or misrepresent a session's nature, organizer, or outcome;
- access, or try to access, accounts, data, or sessions that are not yours;
- probe, scan, overload, disrupt, or test the security of the Service or its infrastructure without our prior written permission;
- circumvent or interfere with security, rate-limiting, authentication, or access-control features;
- reverse engineer, decompile, disassemble, or otherwise modify or alter the Service, except to the extent this restriction is prohibited by applicable law;
- scrape, harvest, or bulk-collect data, create accounts by automated means, or use bots, scripts, or other automated means except through interfaces we provide — including accessing our private or internal APIs other than as we permit;
- imply a false association with, or endorsement by, Nanovote, including by altering the Service or another website to suggest such a link;
- restrict or interfere with any other participant's use or enjoyment of the Service;
- resell, sublicense, or commercially exploit the Service, or use it to build a competing product, without our permission; or
- encourage or help anyone else to do any of the above.
Violation of these Terms of Use may result in termination of your Nanovote account. You understand and agree that Nanovote cannot and will not be responsible for the content posted on the Service and you use the Service at your own risk.
8. Notifications
The Service may send you in-app, push, and email notifications about your sessions and account. You can manage many of these from your profile or your device settings. Some messages — such as security or essential account notices — are part of the Service and cannot be turned off while you hold an account.
9. Privacy
Our Privacy Policy explains what information we handle and how we protect it. By using the Service, you acknowledge that handling.
10. Intellectual property and feedback
The Service — including its software, design, text, and trademarks — belongs to us or our licensors and is protected by law. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service as these Terms intend. We reserve all rights not expressly granted.
You may choose to send us feedback, suggestions, or ideas about the Service — for example, feature requests or bug reports. You agree that we are free to use this feedback for any purpose, including to develop and improve the Service, without any obligation or payment to you. Please don't send us anything you consider confidential or that you don't have the right to share.
11. Availability and changes to the Service
We provide the Service on an "as is" and "as available" basis. The Service is under active development, and features may change. We may modify, suspend, or discontinue any part of the Service at any time, and we may set or change limits such as session sizes or request rates. We are not liable to you for any change, suspension, or discontinuation of the Service.
Nanovote helps you make and keep group decisions, but it is not a backup or archival service. Sessions are automatically and permanently deleted 60 days after they finish — or, for sessions that never finish, 60 days after their last activity — together with everything they hold, including options, votes, and chat messages (see the Privacy Policy for details). Please keep your own record of any decision that matters to you, and don't rely on the Service as your only copy. The Service may also not be available in every country or jurisdiction, and we may limit or withdraw access where the law requires it or where we are unable to provide it.
12. Disclaimers
To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, error-free, or secure, or that any decision, tally, or result produced through the Service is accurate, valid, binding, or fit for any purpose. Nanovote does not provide legal, financial, electoral, or other professional advice and is not a substitute for a certified voting or audit process.
13. Limitation of liability
To the fullest extent permitted by law, we and our suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, use, goodwill, or profits, arising out of or relating to your use of, or inability to use, the Service. Our total liability for all claims relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim and EUR 50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law — for example, liability for death or personal injury caused by negligence, or for fraud.
14. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold us harmless from claims, damages, losses, and expenses (including reasonable legal fees) arising from your content, your use of the Service, the sessions you run, or your breach of these Terms or of anyone's rights — except to the extent the claim is caused by us. If you use the Service purely as a consumer, this section applies only to the extent the law allows.
15. Termination
You can stop using the Service at any time and delete your account from your profile. We may suspend or terminate your access if you breach these Terms, if we are required to by law, or if we reasonably need to in order to protect the Service or other users. Provisions that by their nature should survive termination — including the content license for material others still retain, the disclaimers, the limitation of liability, indemnification, and governing law — will survive.
16. Changes to these Terms
We may update these Terms from time to time. If a change is material, we will take reasonable steps to notify you before it takes effect — for example, by email to registered users or a notice in the app. Your continued use of the Service after a change takes effect means you accept the updated Terms.
17. General
These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Service and replace any prior agreement on that subject. If any provision is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them to an affiliate or to a successor in connection with a merger, acquisition, or sale of assets. Nothing in these Terms creates a partnership, agency, or employment relationship between us.
